These Terms and Conditions set out the basis on which we provide waste removal and collection services in and around Kingston upon Thames. By making a booking, you agree that you have read, understood and accepted these terms. If you do not agree with any part of these Terms and Conditions, you should not use our services.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business, or organisation booking or receiving our waste removal services.
Services means the waste clearance, collection, removal, loading, transportation, and related services carried out by us.
Waste means the items, materials, and rubbish that you ask us to collect and remove, excluding any items we specifically identify as prohibited or restricted.
We, us, our means the waste removal service provider operating in Kingston upon Thames and surrounding areas.
2. Scope of Service
We provide waste removal and rubbish collection services for domestic, commercial, and other premises. Our services typically include loading of waste, transportation, disposal, and recycling where practicable.
We operate within Kingston upon Thames and nearby areas, but we may agree to travel further at our discretion. Any extension of our usual service area may be subject to additional charges, which will be confirmed at the time of booking where possible.
The precise scope of each Service, including the type and volume of waste we will remove, the time and date of collection, and any special requirements, will be agreed during the booking process and reflected in our confirmation to you.
3. Booking Process
3.1 You can request a booking for our Services by phone, email, or through any contact method we advertise. We may ask for photographs, descriptions, or approximate volumes of the waste to provide an estimate.
3.2 Any quotation we give before we attend the site is based on the information you provide. If, when we arrive, the volume, type, or location of the waste differs from what was described, we may revise the quotation accordingly.
3.3 A booking is only confirmed when we have accepted your request and provided a date and, where applicable, a time window for the collection. We reserve the right to refuse a booking for any reason.
3.4 You must ensure that an adult with authority to confirm the work and make payment is present at the property at the agreed time, unless we have expressly agreed in advance that you do not need to be present.
4. Access and Customer Responsibilities
4.1 You must provide clear and safe access to the waste at the agreed time of collection. If we are unable to access the waste due to locked gates, parked vehicles, restricted entry, or other obstacles, we may charge a call-out or wasted journey fee.
4.2 You are responsible for ensuring that the waste to be collected is clearly identified and separated from any items that you wish to keep. We will not be liable for removing items that were not clearly separated from the identified waste.
4.3 You must ensure that any sharp, hazardous, or potentially harmful items are safely contained and disclosed to us in advance. We may refuse to handle items that present an unacceptable risk to health and safety.
4.4 Where we have agreed to collect waste from inside a property, communal area, or other internal space, you must ensure that the area is safe for our operatives to enter and work in, and that passageways are reasonably clear.
5. Waste Types and Restrictions
5.1 Our standard Services are intended for general household, garden, and commercial waste. Certain types of waste, including but not limited to asbestos, clinical waste, needles, chemicals, liquids, gas cylinders, and some electrical items, may be classed as hazardous or restricted.
5.2 You must inform us in advance if you wish us to collect any potentially hazardous or restricted items. We will confirm whether we can accept them, and if so, what additional charges or conditions will apply.
5.3 We reserve the right to refuse to remove any items that we reasonably believe may be hazardous, illegal, or unsuitable for collection or transport, even if we were not informed in advance.
5.4 You confirm that you have the authority to dispose of the waste and that it does not include stolen goods or items that are the subject of any claim or dispute.
6. Pricing, Estimates and Quotations
6.1 Prices are typically based on the volume and type of waste, the labour involved, and the distance and time taken to provide the Services. Additional factors such as difficult access, heavy items, or extra labour may result in higher charges.
6.2 Any price given before we attend the site is an estimate only, based on the information you provide. When we arrive, we will assess the waste and confirm the final price before starting the work wherever reasonably possible.
6.3 If you do not agree to the revised price, you may decline the Service. However, we reserve the right to charge a reasonable call-out, assessment, or cancellation fee to cover our costs.
6.4 All prices are quoted in pounds sterling and, where applicable, are inclusive or exclusive of VAT as specified at the time of quotation.
7. Payments
7.1 Payment is due on completion of the Service unless we have agreed alternative payment terms in writing before the work begins.
7.2 We may accept payment by cash, card, bank transfer, or other methods which we notify to you from time to time. We do not accept payment by cheque unless explicitly agreed in advance.
7.3 For commercial customers, we may at our discretion agree credit terms. In such cases, invoices are payable within the time period stated on the invoice. We reserve the right to charge interest on late payments at the statutory rate and to recover all reasonable costs incurred in pursuing overdue amounts.
7.4 You must ensure that the person present at the collection is authorised to make payment on your behalf. Non-payment or partial payment at the time of collection may result in us refusing to remove some or all of the waste.
8. Cancellations and Changes
8.1 You may cancel or reschedule your booking by contacting us as soon as possible. We ask that you give at least 24 hours’ notice before the agreed collection time.
8.2 If you cancel with less than 24 hours’ notice, we may charge a late cancellation fee to cover our reasonable costs and any lost opportunity to take alternative bookings.
8.3 If we arrive at the property at the agreed time and are unable to complete the Service due to lack of access, absence of an authorised person, unsafe conditions, or other circumstances within your control, we may charge a call-out or wasted journey fee.
8.4 We may cancel or reschedule your booking due to circumstances beyond our reasonable control, including but not limited to extreme weather, vehicle breakdown, staff illness, accidents, or legal restrictions. In such cases, we will attempt to contact you as soon as practicable to arrange a new collection time. We will not be liable for any loss or inconvenience arising from such cancellations or delays.
9. Service Performance and Timeframes
9.1 While we will use reasonable efforts to attend on the agreed date and within any time window provided, all arrival times are estimates and cannot be guaranteed.
9.2 Delays may occur due to traffic, access issues, previous jobs overrunning, or other factors outside our direct control. We will endeavour to keep you informed of any significant delay.
9.3 We will carry out the Services with reasonable care and skill and in accordance with applicable laws and waste regulations.
10. Liability and Limitations
10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury resulting from our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.
10.2 Subject to the paragraph above, we will not be liable for any loss of profits, loss of business, loss of use, or any indirect or consequential losses arising out of or in connection with the provision of our Services.
10.3 Our total liability to you in respect of any claim arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall not exceed the total amount paid or payable by you for the specific Service to which the claim relates.
10.4 You are responsible for protecting floors, carpets, fixtures, and fittings where necessary. While we will take reasonable care when moving waste through your property, we will not be liable for minor scuffs, marks, or damage that could reasonably be anticipated in the normal course of waste removal.
10.5 You must notify us in writing of any claim for damage or loss as soon as reasonably practicable and, in any event, within 7 days of the Service. We may request evidence such as photographs, receipts, or repair estimates to assess the claim.
11. Waste Handling and Environmental Compliance
11.1 We will carry, transfer, and dispose of waste in accordance with applicable UK waste management legislation and regulations.
11.2 Once we have removed the waste from your premises and payment has been made, ownership of the waste transfers to us or to the licensed facility receiving the waste.
11.3 We will take reasonable steps to divert waste from landfill by reusing or recycling materials where practical and economically viable, but we do not guarantee that any specific item will be reused or recycled.
11.4 We may issue a waste transfer note or other documentation where required by law or requested by commercial customers. You must keep any such documentation safe and available for inspection if required.
12. Customer Warranties and Indemnity
12.1 You warrant that the waste you present for collection is your property or that you have full authority from the legal owner to arrange its removal and disposal.
12.2 You warrant that the waste does not contain any substances or items that are prohibited or unlawful to store, transport, or dispose of under applicable law.
12.3 You agree to indemnify us against all claims, damages, losses, costs, and expenses arising out of or in connection with your breach of these warranties or any other term of these Terms and Conditions.
13. Complaints and Dispute Resolution
13.1 If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible, providing full details of your concern.
13.2 We will investigate complaints in a fair and timely manner and attempt to resolve them directly with you. You agree to give us a reasonable opportunity to put things right before taking further action.
14. Data Protection and Privacy
14.1 We will collect and use your personal information solely for the purposes of managing your booking, providing the Services, processing payment, and communicating with you.
14.2 We will take reasonable steps to keep your personal information secure and will not sell or disclose it to third parties except where necessary to deliver the Services, comply with legal obligations, or with your consent.
15. Variations to these Terms
15.1 We may amend these Terms and Conditions from time to time. Any changes will apply to bookings made after the updated terms are published or communicated.
15.2 The version of the Terms and Conditions in force at the time of your booking will apply to that particular Service, unless a change is required by law or regulatory authority.
16. Severability
16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or other competent authority, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.
17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our waste removal services.
